Section 123 of Trademark Act, 1999:

Certain persons to be public servants.

Certain persons to be public servants.—Every person appointed under this Act and every Member of the Appellate Board shall be deemed to be a public servant within the meaning of section 21 of the Indian Penal Code (45 of 1860).
