The CBI and the Special Investigation Team (SIT) submitted status reports on cases of post-poll violence in West Bengal before the Calcutta High Court on Monday.
The reports were submitted in a sealed cover before the division bench of Acting Chief Justice Rajesh Bindal and Justice Rajarshi Bharadwaj.
“All the cases, where, as per the report of the Committee the allegations are about murder of a person and crime against women regarding rape/attempt to rape, shall be referred to CBI for investigation,” stated the order.
A five judge bench of the High Court on August 19 ordered that the CBI would investigate cases of rape and murder related to post-poll violence in West Bengal. It also ordered that an SIT be set up to probe other cases of post-poll violence in the State.
The bench further stated that both the investigations would be court-monitored. The order was issued following a report submitted by a committee of the National Human Rights Commission (NHRC) which recommended a CBI probe into cases of post-poll violence in the State.
It further stated that the Committee, the NHRC or any other commission or authority, the State Government would immediately hand over the “entire record of cases” to the CBI. The High Court warned that any obstruction in the investigation will be viewed seriously.
The bench stated that the SIT shall be headed by IPS officers Suman Bala Sahoo, Soumen Mitra and Ranveer Kumar. It further stated that the investigation of the SIT shall be overviewed by a retired judge of the Supreme Court.
The bench further stated that the SIT will comprise of three IPS officers Suman Bala Sahoo, Soumen Mitra and Ranveer Kumar. It stated that the State Government would not take any adverse action against these officers without prior permission of the Court.
Later Justice (retired) Majula Chellur to “overview” the investigation conducted by the SIT.
The bench posted the matter for hearing on November 8.
